Deputy sheriffs' association suing county

San Diego County is telling its deputy sheriffs that the state’s new public employee pension law mandates new hires pay more toward their retirement.

Not yet, says the Deputy Sheriffs' Association of San Diego County, which cites an existing labor agreement that it says covers the county’s pension obligations for new hires through June 2014.

The association sued the state, the county and the county’s pension administrator in January contending that the pension law that took effect Jan. 1 does not supersede terms of the existing agreement.

Stephen Silver, the attorney representing the roughly 2,200-member association points to a section of the California Public Employees’ Pension Reform Act of 2013 that says any revisions to terms of an agreement in effect before Jan. 1 shall not apply “until the expiration of that contract.”
